Application for a Grant of Probate

A grant of probate is permission from the Supreme Court of WA for an executor to carry out the terms of a deceased's will. You may or may not require a grant of probate.

Banks and other financial institutions, Landgate, and share registries may refuse to allow any dealings in relation to a deceased person's property until the Court has issued the grant.

Included in this offer:

  • One hour initial consultation by Skype or at our office, taking instructions from the executor/s

  • Preparing application for a grant of probate

  • Preparing renunciation or consent forms (if required) for any executor attending the conference

  • Signing and witnessing documents

  • Filing the application at the probate office ($370 application fee is not included)

  • Notifying the executor when the Grant of Probate has been made and forwarding to executor the original Grant of Probate or certified copies if required

  • Up to 1 hour attendance by phone, email, Skype or at the office with the executor obtaining additional information and giving advice if required

  • Letter of advice to executor

This offer excludes:

  • More than 2 meetings with executor to finalise estate

  • Travel

  • Translation of documents

  • Advice on issues other than those matters specifically scoped

  • If the Will is disputed and advice and litigation required to be undertaken

  • Dealing with overseas property

  • Ordering a death certificate

  • Payment of any government, court or other external fees

  • Advertising for creditors in the West Australian and the Gazette

  • Estate administration post grant of probate
